APPÈLSAAK – ADV MENE SÊ MAFUBE KOM HUL PLIGTE NA / APPEAL CASE – ADV MENE SAYS MAFUBE IS FULFILLING THEIR DUTIES

Op Vrydag, 11 Oktober het 'n volbank van die Bloemfonteinse Hooggeregshof, by name regters Chesiwe, Daffue en Hefer, die appélsaak teen Mafube Plaaslike Munisipaliteit (MPM) aangehoor. In 2021 het regter Opperman beveel dat rioolstorting in die riviere rondom Frankfort onmiddelik gestaak moet word. ‘n Verdere bevel in 2022, het hierdie bevel verder uitgebrei na alle rioolwerke onder die bestuur van MPM en die provinsiale owerhede is ook beveel om verpligte intervensie by MPM toe te pas, ingevolge die Grondwet. Samewerking met Mafube Besigheidsforum (MBF) is aanbeveel en om die hulp wat gratis aan die munisipaliteit gebied word te aanvaar.



Nou, 30 maande later is die hofbevel wat dadelik uitgevoer moes word, steeds ongedane sake. Advokaat Bejile Mene wat MPM verteenwoordig het, het aan die hof gesê dat MPM hul pligte uitgevoer het, maar dat hulle ongelukkig nie genoeg geld het om te doen wat van hulle verwag word nie. Regter Daffue het aan hom die vraag gestel waarom die hulp uit die gemeenskap nie aanvaar is nie, waarop Mene die elle-lange prosesse en prosedures van regeringsdepratemente se verkrygingsprosesse verduidelik het - drie tenders, kwotasies ens... Regter Daffue het hom toe herinner dat in die geval van verpligte ingryping en soos hier die geval is; in nood, al die lang paaie nie gevolg hoef te word nie. Die eerste kontrakteur wie aan vereiste voldoen, mag aanvaar word – die gewone verkrygingsproses kan omseil word.


Advokaat Paul Eilers, wie Advokaat Frik Erasmus bygestaan het om MBF te verteenwoordig, het Advokaat Mene se argumente uitmekaar getrek en telkens na die Grondwet verwys.


Na ‘n vier ure-lange hofsessie het die regters die hofverrigtinge verdaag. Die uitspraak is voorbehou sodat hulle die gesprekke van die dag kan oorweeg. Gewoonlik word die uitslag beskikbaar gemaak, so vier maande na die verhoor. MBF is vol vertroue dat die hof in die guns van die gemeenskap, ‘n positiewe uitspraak sal lewer.


Daar was ‘n bietjie gegiggel toe advokaat Mene die hof probeer oortuig het dat MPM darem “iets” gedoen het. Regter Daffue het gevra of hy dit so kan aanteken. Mene het versoek om die "iets" eerder na "iets noemenswaardig" te verander.

On Friday, October 11, a full bench of the Bloemfontein High Court, by the names of judges Chesiwe, Daffue and Hefer, heard the appeal case against Mafube Local Municipality (MPM). In 2021, Judge Opperman ordered that sewage discharge into the rivers around Frankfort must be stopped immediately. A further order in 2022, further extended this order to all sewage works under the management of MPM and the provincial authorities were also ordered to apply mandatory intervention at MPM, in terms of the Constitution. Cooperation with Mafube Business Forum (MBF) was recommended and to accept the help offered free of charge to the municipality.



Now, 30 months later, the court order that should have been executed immediately is still undone. Advocate Bejile Mene who represented MPM told the court that MPM performed their duties but unfortunately they do not have enough money to do what is expected of them. Judge Daffue asked him why the help from the community was not accepted, to which Mene explained the lengthy processes and procedures of government departments' procurement processes - three tenders, quotations etc... Judge Daffue then reminded him that in the case of compulsory intervention and as is the case here; in need, all the long roads need not be followed. The first contractor who meets the requirement may be accepted - the normal procurement process can be bypassed.


Advocate Paul Eilers, who assisted Advocate Frik Erasmus to represent MBF, pulled Advocate Mene's arguments apart and repeatedly referred to the Constitution.

After a four-hour court session, the judges adjourned the court proceedings. The judgment is reserved so that they can consider the discussions of the day. Usually, the result is made available about four months after the trial. MBF is confident that the court will deliver a positive verdict in favor of the community.


There was a bit of giggles when advocate Mene tried to convince the court that MPM had at least done "something". Judge Daffue asked if he could record it that way. Mene requested to change the "something" to "something noteworthy" instead.
